Please read these Terms & Conditions carefully as they constitute an agreement between you (the Participant) and New Horizon Tours (NHT). The Participant agrees to all the terms and conditions of Terms of Use as set forth on this Site as if they were rewritten herein.

To confirm a reservation, a $100 non-refundable deposit is required. Your balance is not due until 60 days prior to departure (120 days for ME Cabo, Villa and Custom packages). Cancellations 60+ days prior to departure are subject to a $100 cancellation charge or forfeit of the $100 non-refundable deposit (120 days for ME Cabo, Villa and Custom packages). Cancellations less than 60 days prior to departure will not receive a refund unless a replacement is found and a $100 name change fee is paid (120 days for ME Cabo, Villa and Custom packages). There will be no refunds for no-shows or cancellations received after departure. There is a $25 charge for returned checks.

Participants are responsible for coordinating with other Participants for their indicated occupancy. For example, if a Participant signs up for a Quad package (four people per room) and one of the three other indicated roommates does not sign up or cancels, the remaining three Participants will be charged the current difference in price between the actual occupancy (Triple) and the intended or paid-for occupancy (Quad).

I represent that I have adequate insurance to cover any injury or damage to myself while participating in the Cabo Spring Break trip and in Cabo Spring Break sanctioned activities and understand that NHT relies upon this fact.  I further represent that I have no medical or physical condition that could interfere with my safety of health while engaged in the Cabo Spring Break and the related activities.  I request and give my permission to NHT that I may be admitted to any hospital or medical facility for diagnosis and treatment.  I request and authorize physicians, dentists, staff and nurses to perform any diagnostic procedures, treatment procedures, operative procedures and x-ray treatment reasonably required or appropriate.

We recommend that the Participant purchase Trip Cancellation insurance, which is not included. In the event of strikes, labor disputes, fires, riots, wars, rebellions, acts of terrorism, weather, acts of God or other circumstances beyond the control of NHT which causes the cancellation of the trip, NHT will refund the tour Participant all amounts paid to NHT less a $200 service fee, and NHT shall be relieved of all obligations and liability to Participant. Participants who jeopardize the welfare of themselves or others will be removed from the trip at their own expense and will not receive any refund. NHT shall not assume responsibility for any claims, losses, damages, cost or expenses arising out of injury, accident or death, damage, loss, stolen or delay of baggage or other personal property, or delay inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether mental or physical. NHT acts as agents for and makes arrangements with suppliers such as airlines, hotels, bus lines and other independent parties to provide you with travel services, accommodations and entertainment. Although care is taken in choosing these suppliers, NHT is unable to directly control them and therefore shall not be held responsible or liable for their acts or omissions. The travel services are subject to the conditions imposed by these suppliers and their liability may be limited by their tariffs, conditions of carriage and international conventions and agreements. In the unlikely event that any part of the trip, travel services or entertainment becomes unavailable prior to departure or during the course of the trip, NHT reserves the right to modify, replace or cancel such service.

If initial reservation is made less than 60 days prior to departure, or if final payment is not received by 60 days prior to departure, price will be subject to air and hotel availability.  Flights selected by Participant are subject to change and are not confirmed until Participant’s account is paid in full.  Final flight information will appear on the Travel Itinerary that will be emailed to Participant and posted on the Participant’s My Account page prior to departure. A $50 change fee plus any price difference applies if Participant requests and is granted a change from the flight originally selected by Participant.

NHT is not responsible for claims made by third parties, campus reps, travel agents, resellers or affiliates about the travel services provided.  Participant is responsible for reading the content of this Site for information pertaining to travel services provided by NHT.

NHT has the exclusive right to include appropriate (no nudity allowed) photographic, video and other visual portrayals of Participant in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to Participant, and all rights, title and interest therein (including all worldwide copyrights therein) shall be NHT’s sole property, free from any claims by Participant or any person deriving any rights or interest from Participant.

These Terms and Conditions shall be governed by the State of California without regard to choice of laws provisions, and the Participant agrees that any dispute of any sort that might arise between the Participant and NHT including your visit to this Site will be governed by such laws.
